PitchPrfct Inc. ("PitchPrfct," "we," "us," or "our") respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website (https://pitchprfct.com, https://app.pitchprfct.com) and use our SMS automation platform and related services (collectively, the "Services").

By using our Services, you consent to the data practices described in this Privacy Policy. If you do not agree with the practices described herein, please discontinue use of our Services.

1. Information We Collect

1.1 Information You Provide Directly

We collect information you provide when you create an account, subscribe to our services, or communicate with us:

  • Account Information: Name, email address, phone number, business name, business address, EIN, SS4 documentation, and other business verification materials.

  • Payment Information: Credit card or other payment method details processed through our third-party payment processor (Stripe). PitchPrfct does not directly store full credit card numbers.

  • Contact Data: Phone numbers, names, and other contact information you upload to the platform for use in your messaging campaigns.

  • Message Content: The content of SMS messages you compose, send, and receive through the platform.

  • Communications: Emails, support tickets, chat messages, and other communications you send to us.

1.2 Information Collected Automatically

When you access our Services, we automatically collect certain information:

  • Usage Data: Pages visited, features used, actions taken within the platform, timestamps, and session duration.

  • Device and Browser Information: IP address, browser type and version, operating system, device type, and screen resolution.

  • Cookies and Tracking Technologies: We use cookies, web beacons, and similar technologies to enhance your experience, analyze usage, and support our marketing efforts. See Section 8 for more details.

  • Log Data: Server logs that record requests made to our servers, including IP addresses, access times, and referring URLs.

1.3 Information from Third Parties

We may receive information from third-party sources:

  • Payment Processor: Transaction confirmations and billing information from Stripe.

  • 10DLC Registration Bodies: Registration status and campaign approval information from The Campaign Registry (TCR) and carrier networks.

  • TCPA Litigator List Providers: If you opt in to our contact scrubbing feature, we check your contact data against third-party TCPA litigator databases to help identify high-risk contacts. This is an optional feature activated at your discretion.

2. How We Use Your Information

We use the information we collect for the following purposes:

  • Provide and Maintain Services: To operate the platform, process messages, manage your account, and deliver the features you use.

  • Process Payments: To charge subscription fees, credit purchases, and other applicable fees.

  • 10DLC Registration: To facilitate your 10DLC campaign registration. Customers may choose to use an optional PitchPrfct-generated opt-in website/landing page to support 10DLC compliance, or they may use their own website and submit their 10DLC registration manually.

  • Customer Support: To respond to your inquiries, troubleshoot issues, and provide technical assistance.

  • Compliance and Safety: To monitor for violations of our Terms and Conditions and Acceptable Use Policy, enforce opt-out handling, manage cooldown periods, and maintain platform integrity.

  • Opt-Out Status Database: To maintain an internal database of contact opt-out statuses (binary flag only) that helps inform other users when a contact has opted out of past campaigns. See Section 5 for full details.

  • Analytics and Improvements: To analyze platform usage, improve our Services, develop new features, and optimize performance.

  • Communications: To send you account-related notifications, service updates, security alerts, and (with your consent) marketing communications.

  • Legal Obligations: To comply with applicable laws, regulations, legal processes, or enforceable governmental requests.

3. How We Share Your Information

PitchPrfct does not sell, trade, rent, or distribute your personal information or your contacts' personal information to third parties. We may share information only in the following limited circumstances:

3.1 Service Providers (Sub-processors)

We share information with trusted third-party service providers who assist us in operating our platform, subject to confidentiality obligations:

  • Payment Processing: Stripe processes your payment transactions.

  • SMS Delivery: Our upstream SMS gateway providers transmit your messages to carrier networks.

  • Hosting and Infrastructure: Cloud hosting providers that store and process platform data.

  • TCPA Litigator Scrubbing: If you opt in, your contact phone numbers are checked against third-party TCPA litigator databases. This data is used solely for the scrubbing check and is not retained by the third party.

A current list of sub-processors is available in our Data Processing Agreement.

3.2 Carrier Networks

To deliver your SMS messages, we transmit message content and recipient phone numbers to carrier networks (e.g., AT&T, T-Mobile, Verizon). Carriers may retain message metadata in accordance with their own policies.

3.3 Regulatory and Registration Bodies

We share business information with The Campaign Registry (TCR) and carrier networks as required for 10DLC registration and compliance.

3.4 Legal Requirements

We may disclose your information if required to do so by law, regulation, legal process, or enforceable governmental request, or if we believe in good faith that disclosure is necessary to:

  • Comply with a legal obligation

  • Protect and defend our rights or property

  • Prevent fraud or address security issues

  • Protect the personal safety of users or the public

3.5 Business Transfers

In the event of a merger, acquisition, bankruptcy, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you via email or prominent notice on our website before your information is transferred and becomes subject to a different privacy policy.

3.6 With Your Consent

We may share your information with third parties when you have given us explicit consent to do so.

4. What We Do NOT Share

To be explicit:

  • We do not sell your personal information.

  • We do not sell your contacts' personal information.

  • We do not share contact lists, phone numbers, names, or message content between users.

  • We do not provide your data to advertisers or data brokers.

  • We do not use your message content for training AI models or for any purpose other than delivering your messages.

5. Opt-Out Status and Risky Leads Database

PitchPrfct maintains an internal risky leads database to improve the user experience and help protect all users from compliance risks. Here is exactly how it works:

5.1 What We Share: Only a binary opt-out flag — a simple yes/no indicator that a specific phone number has opted out of a past campaign on our platform.

5.2 What We Do NOT Share: We do not share the contact's name, the identity of the user whose campaign triggered the opt-out, the content of any messages, the date of the opt-out, or any other information about the contact or the originating account.

5.3 Purpose: This data helps users identify contacts who are more likely to generate complaints or opt-outs, reducing compliance risk across the platform.

5.4 Right to Removal: Any individual may request removal from the risky leads database by contacting PitchPrfct at info@pitchprfct.com. Upon receiving a verified request, we will remove the opt-out flag from our database within 30 days.

6. Data Retention

  • Active Accounts: We retain your data for as long as your account is active and as needed to provide our Services.

  • After Cancellation or Termination: Your data remains accessible in read-only form until the end of your billing period. After the billing period ends, all account data — including contacts, message history, and campaign data — is permanently deleted and cannot be recovered.

  • Aggregated Data: We may retain anonymized, aggregated data that cannot be used to identify any individual for analytical and operational purposes.

  • Legal Obligations: We may retain certain information as required by law, regulation, or legitimate business purposes (e.g., billing records, compliance logs).

7. Data Security

We implement commercially reasonable administrative, technical, and physical security measures to protect your information, including:

  • Encryption of data in transit (TLS/SSL) and at rest

  • Access controls and authentication requirements

  • Regular security assessments and monitoring

  • Employee and contractor confidentiality obligations

However, no method of electronic transmission or storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security. You are responsible for maintaining the security of your account credentials.

8. Cookies and Tracking Technologies

8.1 Types of Cookies We Use

  • Essential Cookies: Required for the platform to function (authentication, session management, security).

  • Analytics Cookies: Help us understand how you use the platform so we can improve it.

  • Preference Cookies: Remember your settings and preferences.

8.2 Managing Cookies

You can control cookies through your browser settings. Disabling certain cookies may affect the functionality of our Services. Most browsers allow you to:

  • Delete individual or all cookies

8.3 Do Not Track

Our website does not currently respond to "Do Not Track" browser signals. We will update this policy if we adopt a Do Not Track standard in the future.

9.1 All Users

9.2 California Residents (CCPA/CPRA)

  • The categories of sources from which the personal information was collected

  • The specific pieces of personal information we have collected about you

Right to Delete. You have the right to request that we delete personal information we have collected from you, subject to certain exceptions.

Right to Correct. You have the right to request that we correct inaccurate personal information we maintain about you.

Right to Opt Out of Sale or Sharing. PitchPrfct does not sell or share your personal information for cross-context behavioral advertising. Therefore, there is no need to opt out. However, if our practices change, we will provide a "Do Not Sell or Share My Personal Information" link on our website.

Right to Limit Use of Sensitive Personal Information. We do not use or disclose sensitive personal information for purposes beyond what is necessary to provide our Services.

Right to Non-Discrimination. We will not discriminate against you for exercising any of your CCPA rights.

Categories of Personal Information Collected: We collect the following categories of personal information:

  • Identifiers: such as name, email address, phone number, and IP address.

  • Commercial Information: such as subscription records, purchase history, and credits.

  • Internet or Other Electronic Network Activity Information: such as usage data and browsing activity on our platform.

  • Professional Information: such as business name, EIN, and business address.

  • Geolocation Data: such as approximate location derived from IP address.

  • Sensitive Personal Information: such as account credentials.

Verification. To protect your privacy, we will verify your identity before fulfilling any CCPA request. We may ask you to confirm your email address, account details, or other identifying information.

Authorized Agents. You may designate an authorized agent to make a CCPA request on your behalf. We may require proof of authorization and verify your identity directly.

9.3 Virginia Residents (VCDPA)

If you are a Virginia resident, you have the right to access, correct, delete, and obtain a copy of your personal data; and to opt out of the processing of personal data for targeted advertising, sale, or profiling. To exercise these rights, contact us at info@pitchprfct.com. You may appeal a decision regarding your request by contacting us at the same address.

9.4 Colorado Residents (CPA)

If you are a Colorado resident, you have similar rights to access, correct, delete, and obtain a portable copy of your personal data; and to opt out of targeted advertising, sale of personal data, or profiling. To exercise these rights, contact us at info@pitchprfct.com.

9.5 Connecticut Residents (CTDPA)

If you are a Connecticut resident, you have the right to access, correct, delete, and obtain a copy of your personal data; and to opt out of the processing of personal data for targeted advertising, sale, or profiling. To exercise these rights, contact us at info@pitchprfct.com.

9.6 Other State Privacy Laws

PitchPrfct complies with all applicable state privacy laws. If you are a resident of a state with consumer privacy legislation not specifically listed above, you may still exercise your rights by contacting us at info@pitchprfct.com. We will process your request in accordance with the applicable law.

10. Children's Privacy

Our Services are not directed to individuals under the age of 18. We do not knowingly collect personal information from children. If we become aware that we have collected personal information from a child under 18, we will take steps to delete that information promptly. 11. International Users

Our Services are operated in the United States and are intended for users located in the United States.
